Amendments to the Technical Regulation on Cosmetic Products

Resolution of the Cabinet of Ministers of Ukraine No. 737 dated 4 June 2026 introduced amendments to the Technical Regulation on Cosmetic Products, in particular:

  • a final deadline has been set for making available on the market cosmetic products that were placed on the market before 3 August 2026 and do not comply with the requirements of the new Technical regulation — such products may be made available on the market until 3 August 2030;
  • the lists of prohibited ingredients and ingredients permitted subject to certain conditions/restrictions in Annexes 2–6 to the Technical Regulation have been aligned with Regulation (EC) No. 1223/2009 on cosmetic products;
  • certain exemptions from the requirements of Annex 3 have been permitted for a period of one or two years, until 3 August 2027 and 3 August 2028, respectively.

Please note that the date of 3 August 2030 does not mean that the transitional period has been extended

3. To establish that the making available on the market of cosmetic products placed on the market before 3 August 2026 may not be prohibited or restricted on the grounds of non-compliance of such cosmetic products with the requirements of the Technical Regulation approved by this Resolution.

New:

3. To establish that the making available on the market of cosmetic products that have not been notified, were placed on the market before 3 August 2026, and do not comply with the requirements of the Technical Regulation approved by this Resolution shall be permitted until 3 August 2030.

Accordingly, the transitional period remains unchanged and ends on 3 August 2026. In simple terms, cosmetic products placed on the market before 3 August 2026 (imported, in the case of imported products, or manufactured, in the case of domestic products) may be non-compliant with the requirements of the new Technical Regulation. Such products may be made available on the market, i.e. sold, until the end of their shelf life, but no later than 3 August 2030.

Cosmetic products placed on the market from 3 August 2026 must fully comply with the requirements of the new Technical Regulation, in particular regarding the definition and scope of a cosmetic product, compliance of the composition with Annexes 2–6, taking into account the exemptions approved by Resolution No. 737 dated 4 June 2026, appointment of a Responsible Person, compliance of labelling with the new requirements, preparation of the Product Information File and the Cosmetic Product Safety Report taking into account national requirements, keeping these documents available to the authorities, and notification of the product on the Ministry of Health portal.
