Transitional Period Under the Technical Regulation on Cosmetic Products Extended
Resolution No. 976 of the Cabinet of Ministers of Ukraine, dated 29 July 2026, has extended the transitional period under the Technical Regulation on Cosmetic Products from 3 August 2026 until 31 July 2027.
This means that the making available on the market of cosmetic products placed on the market by 31 July 2027 may not be prohibited or restricted on the grounds of non-compliance with the requirements of the new Technical Regulation. Put simply, cosmetic products placed on the market by 31 July 2027, i.e. imported by that date in the case of imported products or manufactured by that date in the case of domestic manufacturers, need not comply with the requirements of the new Technical Regulation.
The final date for making available on the market products that were placed on the market during the transitional period and do not comply with the requirements of the Technical Regulation remains unchanged: 3 August 2030.
The Resolution also provides for a revised version of paragraph 25 of the Technical Regulation, which establishes the requirements applicable to cosmetic product safety assessors. The annex containing the revised wording of this paragraph has not yet been published on the Government Portal. However, the previously published draft provided that a safety assessment could be carried out by a person holding a master’s degree in speciality I2 “Medicine”, I8 “Pharmacy”, or a related speciality included in a list approved by the Ministry of Health of Ukraine.
We welcome this important and long-awaited decision, which gives market participants additional time to progressively align cosmetic product documentation, labelling and notification with the new requirements.
